Motley Fool Projects Terms and Conditions of Service

Welcome to Motley Fool Projects (the ”Project(s)”). This page sets forth special Terms and Conditions by which The Motley Fool provides you with access to Projects (the "Terms"). It supplements the Fool's Rules (our standard terms and conditions), which are incorporated by reference. By accessing and utilizing the Projects you are agreeing to abide by these Terms as well as the Fool's Rules INCLUDING THE BINDING ARBITRATION AND CLASS ACTION WAIVER DETAILED IN SECTION 13 OF THE FOOL’S RULES.

1. Motley Fool Projects

These Projects contain early, unfinished versions of tools, services, functions, and/or applications that are intended to help investors make decisions.

You may access a Project at our sole discretion. While you have no obligation to use any Project, if you elect to do so, then your use and access shall be subject to these Terms and Conditions. A list of current Projects is provided below in section 1(a).

All services and features of the Projects are provided “AS IS.” The Fool assumes no responsibility for the timeliness or delivery of any content or the deletion or failure to store any personalized or customized settings. The Projects, by definition, are still in the development stage. Accordingly, from time to time, we may change the appearance, functionality, features, offerings, and structure of the Projects, as well as the types of Projects offered, and reserve the right to do so without advance notice to you of any material changes.

The Projects may rely on factors such as historical data, the expertise of investors at The Motley Fool, algorithmic calculations, journalistic publications, social media, and investor’s inputs to produce the resulting data. These Projects may malfunction, the premise upon which they are built may be inaccurate, our team may be wrong about the results that are displayed for members, and past performance is not a guarantee of future results. The Motley Fool investment team’s picks may be wrong, and investing in them, like making any investment, could result in loss.

Some Projects may include links to third party sites or services. These sites are not the property or responsibility of The Motley Fool, and we cannot and will not claim that they are accurate. Your use of any such third-party sites and services is subject to their terms and conditions, and done at your own risk.

The Motley Fool and the designers of these Projects will not be liable for any investment decision you make, or action you take based upon reliance of any material you read here. News Aggregator: The News Aggregator is designed to help you find information related to finance, financial markets, and publicly traded companies by providing a summary of news social media posts to help you identify the stories and information of interest to you.

2. Feedback and Intellectual Property

We may ask you to provide suggestions, enhancement requests, and/or recommendations (individually and collectively, “Feedback”) about Projects, or The Motley Fool more generally. If you give us Feedback, we have no obligation to act on it, but we may use, modify, and incorporate this Feedback into the Projects and other Motley Fool products and/or services without any restriction and without any payment to you.

You further agree that the information included in or related to the Projects or The Motley Fool products, services, business or technology plans, you may come in contact with, is not a promise or statement about anything we are doing or may do in the future, and is not binding us to any particular course of business, product strategy, and/or development, or promising anything to you.

The Motley Fool maintains all rights, title and interest in and to all its patents, inventions, copyrights, trademarks, domain names, trade secrets, know-how and any other intellectual property and/or proprietary rights (collectively, “Intellectual Property Rights”). The limited rights granted to you to access and use the Projects under these Terms do not convey any additional rights in the Projects or in or to any Intellectual Property Rights associated therewith. Subject only to the limited rights to access and use the Projects as expressly provided herein, all rights, title and interest in and to the Projects and all hardware, software and other components of or used to provide the Projects, including all related Intellectual Property Rights, will remain with and belong exclusively to The Motley Fool.

3. Confidential Information

From time to time, utilizing a Project and providing Feedback under these terms may result in The Motley Fool disclosing certain confidential, proprietary and/or trade secret information related to the Projects and/or The Motley Fool (the “Confidential Information”). Such Confidential Information includes, but is not limited to, the features, functionality and existence of the Projects, as well as any know-how, flowcharts, diagrams, development tools, specifications, design notes, or marketing information that may be made available to you. You understand and agree that you will not, without the express prior written consent of The Motley Fool, disclose any Confidential Information or any part thereof to any third party.

At any time by request of The Motley Fool, you will return all Confidential Information in its possession to The Motley Fool and further agree that you will not duplicate, translate, modify, copy, print, disassemble, decompile or otherwise tamper with the Project or any Confidential Information associated therein.

4. Disclaimer of Warranties and Liabilities

By using Motley Fool Tools, you agree that The Motley Fool, its directors, its employees, and its agents will not be liable for any investment decision made or action taken by you and others based upon reliance on any information we publish through these Tools. Please remember that past results are not necessarily indicative of future performance.

Under no circumstances will The Motley Fool, its employees, or its agents be liable for direct, indirect, incidental, or any other type of damages resulting from your use or downloading of any material on our sites, even if we have been advised of the possibility of such damages. This includes, but is no way limited to, loss or injury caused in whole or in part by our negligence or by things beyond our control in creating or delivering the Service or any of our services. This disclaimer of liability does not apply in New Jersey.

Although this is included in the Fool's Rules, it bears repeating (and capitalizing):

ALL INFORMATION PROVIDED OR MADE AVAILABLE THROUGH THE SERVICE ARE PROVIDED "AS IS." THE MOTLEY FOOL HEREBY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. WITH RESPECT TO OUR WEBSITES, OUR SERVICES, ANY CONTENT, TOOLS, OR PRODUCTS, YOU EXPRESSLY AGREE THAT YOU WILL ASSUME THE ENTIRE RISK AS TO THE QUALITY AND THE PERFORMANCE OF OUR SERVICES AND THE ACCURACY AND COMPLETENESS OF ITS CONTENT.

Some States do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such states, our liability and that of our third party content providers will be limited to the greatest extent permitted by law. This disclaimer of warranties does not apply in New Jersey.

5. You Bear Responsibility for Your Financial and Investment Decisions.

While our purpose is to help you become a better investor, your investment decisions rest squarely with you. You agree that you bear sole and complete responsibility for your investment and financial decisions.

6. Trading Rules

The Motley Fool strives to operate with the highest level of integrity and to treat everyone -- our customers, employees and community -- fairly. For this reason, all of our Premium Services abide by trading rules.
